I’ve decided to put my two cents into this debate. Since President Obama’s swipe at Supreme Court for upholding the Constitution, I’m stunned at the response by the media and the American public. From what I’ve heard about this decision it comes down to: the big, bad corporation ran by evil capitalists will take over our political system at the expense of “the little guy”. This has been spewed by the likes of Bill O’Reilly of The O’Reilly Factor. I would expect the mainstream media to get themselves in a tizzy since they don’t respect “the little guy” or the Constitution or the United States of America. But Fox News Channel has a massive audience, particularly those who have no political affiliation. I count myself in that category. But O’Reilly should be ashamed of himself for not looking deeply into this ruling. He is, unfortunately a product of a larger problem in this country’s political discourse.
The educational system in the U.S. has left the citizenry unable to think in principle. When I heard this decision, I breathed a sigh of relief. In essence, this decision, Citizens United vs Federal Elections Commission struck down a law that denied corporations the right to freedom of speech because they organized as a corporation. Got that? Let me put it as an example. Suppose as an individual, Bookish Babe, starts a petition against my local government for any given issue effecting my community. If I criticize an official for supporting this issue, I have freedom of speech on my side. I can post flyers, create DVDs, anything that will get my message out. But if I organized as Bookish Babe, Inc. with 2, 3 or 50 individuals on my side and financial backing against said official, I wouldn’t be allowed my first amendment right. See what it boils down too? This is a gross violation of what our Founding Fathers understood about government encroachment. That was the whole point of the Bill of Rights. The First Amendment reads as follows:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.(Bold added)
Peaceably assemble includes forming as a corporation. This goes beyond the hypocrisy of President Obama or Congress. Since everyone in Congress and the White House has taken money from corporations whom they deem important. They are able to shell out favors, with taxpayers monies to the very corporations they took donations from. But an ordinary citizen, who doesn’t have lobbyists to do their talking for them can’t organize as a corporation?!?! These philosopher kings a la Plato think that their capricious rules don’t apply to them. I’ll let Justice Clarence Thomas explain.
This ruling should have caused cheering in the streets. Unfortunately, that has not been the case. The reaction gives me a chill down my spine from Americans who don’t realize this decision strengthens freedom of speech. If the average citizen can’t see this then the country is in serious, intellectual trouble.
